These Terms & Conditions apply to all waste management, recycling, sustainability, and related services provided by 888 Waste Pty Ltd (“888 Waste”, “we”, “us”, “our”) to the customer (“you”, “your”).
By engaging our services, placing an order, or accepting delivery, you agree to be bound by these Terms & Conditions.
1. Services
1.1 888 Waste provides waste management and related services including (but not limited to):
- Skip bin hire
- Waste and recycling collection
- Resource recovery
- Sustainability audits and consulting
1.2 Services are provided in accordance with the details agreed at the time of booking or contract.
2. Quotes & Orders
2.1 All quotes are based on the information provided by you and are valid for 30 days unless otherwise stated.
2.2 We reserve the right to revise pricing if the scope of services changes or information provided is incorrect or incomplete.
2.3 An order is confirmed once accepted by 888 Waste in writing or by commencement of services.
3. Customer Obligations
3.1 You must ensure:
- Safe, clear, and legal access to service locations
- Accurate description of waste types and volumes
- Compliance with all applicable laws and regulations
3.2 You must not place prohibited, hazardous, or regulated waste into any container unless expressly agreed in writing.
4. Waste Types & Compliance
4.1 Only waste types approved by 888 Waste may be collected or removed.
4.2 Prohibited waste may include (but is not limited to):
- Asbestos or asbestos-containing materials
- Hazardous or regulated waste
- Liquid waste
- Explosives or flammable materials
- Medical or clinical waste
4.3 If prohibited or undeclared waste is identified, 888 Waste may:
- Refuse service
- Remove the waste at your cost
- Charge additional handling, transport, and disposal fees
- Report the matter to relevant authorities where required by law
5. Access, Delays & Failed Services
5.1 You must provide safe access for service vehicles and equipment.
5.2 If a service cannot be completed due to access issues, obstructions, or incorrect instructions, a failed service fee may apply.
5.3 We are not liable for delays caused by traffic, weather, mechanical issues, or circumstances beyond our reasonable control.
6. Equipment Responsibility
6.1 Where bins, skips, or other equipment are supplied, you are responsible for them from delivery until collection.
6.2 You are liable for loss, theft, or damage beyond fair wear and tear.
6.3 Equipment must not be relocated or altered without our consent.
7. Health, Safety & Environment
7.1 You must comply with all applicable Work Health & Safety (WHS) and environmental laws.
7.2 Services must not be used in a manner that creates a safety risk, obstruction, or nuisance.
7.3 888 Waste will manage waste in accordance with Victorian and Commonwealth environmental legislation.
8. Pricing & Payment
8.1 Fees are charged in accordance with agreed pricing or current rate schedules.
8.2 Additional charges may apply for:
- Overweight bins
- Extended hire periods
- Prohibited or undeclared waste
- Failed or aborted services
8.3 Payment terms are as agreed at booking or contract commencement.
8.4 Late payments may incur interest or recovery costs to the extent permitted by law.
9. Cancellations & Variations
9.1 Service cancellations or changes must be made at least 24 hours prior to the scheduled service unless otherwise agreed.
9.2 Late cancellations may attract a fee.
10. Sustainability & Recycling Outcomes
10.1 Where recycling or sustainability services are provided, 888 Waste will use reasonable efforts to maximise resource recovery.
10.2 Recycling outcomes may vary depending on contamination, waste composition, and market conditions.
11. Liability & Indemnity
11.1 To the extent permitted by law, you indemnify 888 Waste against any loss, damage, or claim arising from:
- Incorrect waste classification
- Breach of these Terms
- Your negligence or unlawful conduct
11.2 Our liability is limited to the value of the services supplied.
11.3 Nothing in these Terms excludes rights or remedies available under the Australian Consumer Law.
12. Insurance
12.1 888 Waste maintains appropriate insurance as required by law.
12.2 You are responsible for insuring your property and activities.
13. Force Majeure
13.1 888 Waste is not liable for failure or delay due to events beyond reasonable control, including extreme weather, industrial action, road closures, or government restrictions.
14. Privacy
14.1 Personal information is handled in accordance with our Privacy Policy and applicable privacy laws.
15. Governing Law
15.1 These Terms & Conditions are governed by the laws of Victoria, Australia.
15.2 The parties submit to the exclusive jurisdiction of the courts of Victoria.
16. Acceptance
By engaging 888 Waste, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
